Terms of Service - Foodie Choice

Welcome to "Foodie Choice" (hereinafter referred to as "this Service"). Please read the following Terms of Service carefully before using this Application. By registering or utilizing this Service, you acknowledge that you have read, understood, and fully agreed to all provisions herewithin. If you do not agree to these Terms of Service, please stop using this Service immediately.

1. Description of Services & Platform Architecture

This Service provides restaurant searches, map navigations, customized favorites synchronization, collaborative dining decision rooms (voting), and gathering schedule management. This Service consists of free functionalities and a paid premium tier (Foodie Pro).

To ensure optimal system performance and safety, this Service utilizes a hybrid cloud architecture, including but not limited to Google Firebase, Supabase, and Apple CloudKit. The developer reserves the right to modify, upgrade, suspend, or terminate all or part of this Service at any time.

2. Subscription Terms & Payments

By subscribing to "Foodie Pro," you agree to the following terms:

Automatic Renewal: Subscription fees will be billed via your Apple ID. Subscriptions automatically renew monthly or annually unless canceled at least 24 hours prior to the end of the current billing cycle.
Cancellation: You can manage or cancel your subscription at any time via your App Store Account settings.
Refund Policy: All subscription transactions are entirely managed by the Apple App Store. Any refund requests must be submitted through their official procedures.
Daily Search Limits: Free tier users are subject to daily restaurant search quota limitations. Subscribing to "Foodie Pro" removes all limits and unlocks an ad-free premium experience.

3. User Conduct Guidelines

Users must comply with all applicable local and international laws. You shall not use this Service for any unlawful activities, including but not limited to:

Reverse engineering, decompiling, disassembling, or attempting to extract any source code of this Service.
Utilizing any automated tools, scrapers, bots, or load testing programs to overload or interfere with server performance or API usage.
Posting violent, pornographic, hateful, defamatory, or fraudulent content within dining voting rooms or group features.
Maliciously creating large numbers of empty voting rooms or interfering with other users' decision-making processes.
Export Control: You represent and warrant that you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and you are not listed on any U.S. Government list of prohibited or restricted parties.

4. Prohibition of Malicious Attacks & Cloud Cost Indemnification

This Service is built on scalable cloud services billed on a pay-as-you-go basis. We strictly prohibit any form of malicious cyber attacks or server abuse, including but not limited to:

Distributed Denial of Service (DDoS) attacks.
Sending disproportionate, automated, or looping queries to APIs (e.g., Google Places API) or databases (Supabase, Firebase).
Attempting to bypass subscription logic, quota checks, or security filters.

If a user's malicious activities (whether intentional or not) cause our cloud hosting infrastructure (Supabase, Firebase, Google Maps API, etc.) to incur abnormally high billing charges or system damages, the user shall be held fully liable for all associated costs. The user agrees to fully indemnify the developer for all direct and indirect losses (including reasonable investigation expenses and attorney fees).

5. Disclaimer of Warranties (AS-IS)

THIS SERVICE IS PROVIDED ON AN "AS-IS" AND "AS-AVAILABLE" BASIS. All restaurant information (including business hours, address, reviews, and maps) are provided by third-party APIs and public data for reference only. We make no guarantees regarding their absolute accuracy, integrity, or real-time status. We are not responsible for any errors, delays, or omissions in third-party data. Users bear all risks associated with using this Service. The developer shall not be held liable for any loss or damages.

6. Third-Party Links & Services

This Service may contain links to third-party websites (e.g., restaurant websites, social media). These sites are governed by their own terms, and the developer assumes no responsibility for their content, privacy policies, or practices.

7. Termination

The developer reserves the right to terminate or suspend your access to the Service immediately, without prior notice, for conduct that the developer believes violates these Terms or is harmful to other users, the developer, or third parties.

8. Intellectual Property Rights

All source code, UI designs, and trademarks of this Application are the exclusive property of the developer. No unauthorized replication or commercial exploitation is permitted.

9. Governing Law & Jurisdiction

These Terms shall be governed by the laws of the Republic of China (Taiwan). Any legal action arising from these Terms shall be submitted exclusively to the Taiwan Taoyuan District Court.
